Welcome to GamingLab, a gaming platform owned and operated by EestIBIK OÜ, located at Pärnu mnt 139c, Kesklinna linnaosa, 11317 Tallinn, Harju maakond, Estonia (“we,” “us,” or “our”). Our platform hosts online games (including “Hikari World”), virtual goods, and other related services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms and Conditions (“T&Cs”). If you do not agree to these T&Cs, you must not access or use GamingLab.
1. General Provisions
1.1 Scope
These T&Cs govern your use of GamingLab’s websites, online games, virtual items, and related content. They also govern the purchasing of virtual goods (e.g., coins, skins, clothing, or other digital artifacts) for real money.
1.2 Applicable Law
These T&Cs are governed by and construed in accordance with the laws of Estonia, and, where applicable, they comply with relevant EU and UK regulations.
1.3 Eligibility
You may only use our Services if (a) you are at least 16 years of age, or (b) your parent or legal guardian has reviewed and agreed to these T&Cs on your behalf, as required by applicable law. If you are under 16, please refrain from using our Services unless you have such consent.
1.4 Updates
We reserve the right to update or modify these T&Cs at any time, to reflect changes in law or our business operations. If material changes occur, we will notify users by email or by posting a notice on the Site. Continued use of GamingLab following any update constitutes acceptance of the revised T&Cs.
2. Account Creation and Security
2.1 Account Registration
- You may be required to create an account to access certain features.
- By creating an account, you represent that all registration information you submit is current, accurate, and complete.
- You agree to keep your account information up to date.
2.2 Account Security
- You are solely responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activities that occur under your account.
- If you suspect unauthorized use of your account, please notify us immediately at info@hikariworld.com.
2.3 Account Suspension/Termination
We reserve the right, at our sole discretion, to suspend or terminate your account if:
- You violate these T&Cs or any other GamingLab policies.
- You engage in unlawful, fraudulent, or abusive activity.
3. Virtual Goods, Purchases, and Refunds
3.1 Virtual Goods
- “Virtual Goods” refers to in-game items, currencies, skins, boosts, or similar digital artifacts.
- Virtual Goods have no real-world monetary value and cannot be withdrawn, transferred, or redeemed for actual currency (unless explicitly stated by law).
- Virtual Goods are licensed to you under these T&Cs, not sold; you acquire no ownership interest in them.
3.2 Purchases
- You may purchase Virtual Goods or other items using real currency.
- All purchase orders are subject to availability and acceptance by us.
- The prices and payment methods for Virtual Goods may change at any time prior to order acceptance.
3.3 Refunds
- GamingLab may issue refunds for unused and unconsumed Virtual Goods in accordance with applicable EU or UK law or other mandatory consumer protection statutes.
- To request a refund, submit a written request to [Support Email] along with proof of purchase.
- We reserve the right to decline refund requests if items have been used, accessed, or otherwise consumed, or if the request does not comply with any legal refund requirement.
- We offer a refund within 14 days of purchase. The refunded amount will be credited back to the payment method used for the purchase.
3.4 Expiration of Virtual Goods
- Certain Virtual Goods may have expiration dates. If you do not use them before their expiration, we have no liability to restore or reimburse them.
3.5 Payment through Unauthorized Channels
- We are not responsible for any issues arising from purchases made outside our authorized platforms or payment channels.
4. User Conduct and Restrictions
4.1 Code of Conduct
By using GamingLab, you agree not to engage in activities or submit any content that:
- Violates any applicable laws or regulations.
- Infringes or violates the rights of others, including intellectual property rights and privacy.
- Is fraudulent, misleading, or deceptive.
- Is defamatory, obscene, offensive, or harmful to individuals or groups.
- Promotes hate speech, violence, extremism, or illegal activities.
- Involves cheating, hacking, or using unauthorized third-party software (“plug-ins” or “mods”).
- Attempts to reverse-engineer, decompile, or tamper with GamingLab’s technology.
- Involves trading, selling, sharing, renting, or transferring accounts or Virtual Goods, unless explicitly authorized by us.
- Harms or disrupts our Services, servers, or networks.
4.2 Remedial Measures
- We may warn, suspend, or ban accounts that violate our Code of Conduct.
- We may remove or block any content or items in your account without prior notice if we have reason to believe you violate these T&Cs or applicable law.
5. Intellectual Property
5.1 Ownership
All intellectual property rights (including trademarks, copyrights, and patents) in GamingLab’s Services, including but not limited to the game “Battle Revolution,” text, images, videos, audio, software, and other materials, are owned by or licensed to EestIBIK OÜ unless otherwise specified.
5.2 License Grant
We grant you a personal, non-transferable, non-exclusive, revocable license to access and use the Services for your private, non-commercial entertainment purposes, subject to these T&Cs. No other license or rights are granted.
5.3 User-Generated Content (“UGC”)
- You retain ownership of any original content you post or submit.
- By uploading UGC, you grant us a worldwide, irrevocable, perpetual, royalty-free, sub-licensable license to use, reproduce, adapt, modify, publish, distribute, and display that content in connection with GamingLab’s Services.
- You warrant that any UGC you provide does not infringe the rights of any third party.
6. Dispute Resolution and Governing Law
6.1 Governing Law
These T&Cs are governed by the laws of Estonia, without regard to conflict-of-law principles. Where required by EU or UK law, mandatory consumer protection provisions will apply.
6.2 Jurisdiction
All disputes arising out of or relating to these T&Cs shall be subject to the exclusive jurisdiction of Estonian courts. However, we reserve the right to engage in alternative dispute resolution methods if both parties agree.
6.3 Informal Resolution
In the event of a dispute, you agree to contact us first at info@hikariworld.com to attempt to resolve the issue informally before pursuing formal legal action.
7. Limitations of Liability
7.1 No Warranty
- GamingLab Services are provided “as is” and “as available” without warranties of any kind, whether express or implied.
- We do not warrant uninterrupted, error-free, or virus-free operation.
7.2 Indirect Damages
To the maximum extent permitted by law, EestIBIK OÜ, its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of revenue or data.
7.3 Liability Cap
If, notwithstanding these T&Cs, liability is imposed on GamingLab, our total liability shall not exceed the amount you have paid for the specific Virtual Goods or Services in question in the twelve (12) months preceding the claim.
7.4 User Responsibility
You agree to indemnify and hold us harmless from any claims, liabilities, damages, or expenses arising out of your breach of these T&Cs or your unlawful, negligent, or improper use of the Services.
8. Account Termination and Data Deletion
8.1 Termination by User
You may request the deletion of your account at any time by contacting us at info@hikariworld.com. Upon verification, we will remove your personal information and account data in accordance with applicable law and our Privacy Policy.
8.2 Termination by GamingLab
We may terminate or suspend your account if you violate these T&Cs, applicable law, or if required by regulatory authorities. Upon termination, you forfeit access to Virtual Goods, in-game items, or any other in-platform benefits.
8.3 Data Retention
After account termination, we will follow our data retention policy, as outlined in our Privacy Policy, and will delete or anonymize your personal information unless required to keep it for legal obligations.
9. Force Majeure
GamingLab shall not be liable for any delay or failure to perform due to causes beyond our reasonable control, including, but not limited to, acts of God, natural disasters, war, terrorism, riots, embargoes, strikes, governmental acts, or other similar events.
10. Miscellaneous
10.1 Entire Agreement
These T&Cs, together with our Privacy Policy and any other specific rules or policies referenced herein, constitute the entire agreement between you and GamingLab and supersede any prior agreements, written or oral.
10.2 Severability
If any provision of these T&Cs is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
10.3 No Waiver
No failure or delay by GamingLab to exercise or enforce any right or provision of these T&Cs shall operate as a waiver of such right or provision.
